NETAI TERMS AND CONDITIONS OF USE

1.     Acceptance of Terms
By accessing or using www.netai.co.ke (the “Site”) operated by Netai (“Company,” “we,” or “us”), you agree to comply with these Terms and Conditions (“Terms”).

If you disagree, do not use the Site.

Binding Arbitration
All disputes related to these Terms or your use or purchases on the Site will be resolved through BINDING ARBITRATION, waiving your right to court or class actions. See Section 12 for details.

2.     Ownership and Intellectual Property

Videos, designs and the Netai logo on the Site are owned by Netai or its licensors. You may not copy, modify, or exploit any content without written permission.

 

3.     Account Security

• Registration: To purchase products, you may need to create an account. Safeguard your password and notify us immediately of unauthorized use.
• Termination: We reserve the right to suspend or terminate accounts for violations.

 

4.     Product Information and Pricing

• Accuracy: We strive for accuracy but do not guarantee error-free product descriptions, pricing, or images. We reserve the right to correct errors and cancel orders arising from inaccuracies.
• Modifications: Product availability, prices, and promotions may change without notice.

 

5.     Orders and Payments

• Order Acceptance: Orders are subject to availability. We may refuse or limit orders at our discretion.
• Payment: Accepted methods include credit/debit cards and PayPal. You authorize us to charge your selected payment method.
• Sales Tax: Applicable taxes will be added at checkout.
• Account Security: Keep login credentials confidential. Update billing/shipping details promptly.

6.     Shipping and Returns

• Shipping: Delivery times are estimates. We are not liable for delays caused by carriers or unforeseen events.

PRODUCTS ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

11.  Limitation of Liability

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM PRODUCT USE OR SITE ACCESS. OUR MAXIMUM LIABILITY IS THE PURCHASE PRICE OF THE PRODUCT.

12.  Dispute Resolution and Arbitration

All disputes related to these Terms or your use of the Site or any purchases on the site shall be resolved through BINDING ARBITRATION in Kenya, administered by the Nairobi Centre for International Arbitration (NCIA). You waive the right to pursue disputes in court or through class actions.

13.  INDEMNIFICATION

You agree to indemnify Netai against claims arising from your breach of these Terms or misuse of the Site.

14.  PRIVACY

Your data is governed by our Privacy Policy, which outlines collection, use, and protection practices.

15.  ONLINE STORE TERMS

• You represent that you are the age of majority in Kenya (18+) or have consent from a legal guardian.
• Prohibited: Illegal use of products, transmitting harmful code, or violating laws (e.g., intellectual property rights).

 

16.  Revisions

We may update these Terms at any time. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of Kenya, without regard to conflict of laws principles.
